Welcome to Weby Portal (“Weby”, “we”, “our”, or “us”).
These Terms & Conditions (“Terms”) govern your access to and use of the Weby website and mobile application (collectively, the “Service”).

By accessing or using Weby, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Service.

1. About Weby

Weby is a digital commerce and order-management platform operated in Kuwait, enabling businesses (“Vendors”) to list products and receive orders from customers (“Users”) via web and mobile applications.

Weby acts solely as a technology service provider and does not manufacture, stock, or directly sell products unless explicitly stated.

2. User Accounts

To use certain features, you may be required to create an account.

You agree to:

Provide accurate and current information
Maintain the confidentiality of your login credentials
Notify us immediately of any unauthorized use

Weby is not responsible for losses resulting from unauthorized account access due to user negligence.

3. Orders & Vendor Responsibility

Orders placed through Weby are forwarded to the respective Vendor.
Vendors are solely responsible for:
- Product descriptions and pricing
- Availability and fulfillment
- Delivery timelines and quality

Weby is not liable for vendor-related delays, cancellations, or disputes.

4. Payments

Weby does not store credit/debit card details.
Payments, if enabled, are processed through third-party payment providers.
Weby is not responsible for payment processing errors, delays, or chargebacks handled by third parties.

5. Cancellations & Refunds

Refund and cancellation policies are defined by each Vendor.
Weby does not guarantee refunds unless explicitly stated by the Vendor.
Any disputes must be resolved directly between the User and the Vendor.

6. Push Notifications

By using the Weby app, you consent to receive:

Order status notifications
Service and operational alerts

You may disable notifications at any time through your device settings.

7. Acceptable Use

You agree not to:

Use the Service for unlawful purposes
Attempt unauthorized access to systems or data
Upload malicious software or harmful content
Disrupt or interfere with platform functionality

Violation may result in suspension or termination of access.

8. Intellectual Property

All content, software, designs, trademarks, and logos used in Weby are the property of Weby or its licensors.

Unauthorized copying, modification, distribution, or reverse engineering is strictly prohibited.

9. Third-Party Services

Weby may integrate or link to third-party services.

Weby is not responsible for:

Third-party content or availability
Third-party privacy or security practices

Use of such services is at your own risk.

10. Service Availability

Weby aims to provide reliable access but does not guarantee uninterrupted service.

We may:

Perform maintenance
Modify or discontinue features
Temporarily suspend access

Without prior notice when necessary.

Continuous availability
Error-free operation

Loss of profits, data, or business
Vendor-related issues

Total liability shall not exceed any amount paid by the User to Weby, if applicable.

14. Indemnification

You agree to indemnify and hold Weby harmless from any claims arising from:

Your use of the Service
Violation of these Terms
Infringement of third-party rights

15. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the State of Kuwait.

The courts of Kuwait shall have exclusive jurisdiction over any disputes arising from these Terms or the use of the Service.

16. Changes to Terms

Weby may update these Terms from time to time.

Continued use of the Service after changes indicates acceptance of the revised Terms.
